Effective Date: July 6, 2026
These Terms of Service (“Terms”) govern all calibration, inspection, repair, preventive maintenance, field service, consulting, and related technical services (“Services”) provided by Gordon Technical Sales & Service, Inc. (“Gordon Technical,” “we,” “our,” or “us”).
By requesting or receiving our Services, you agree to these Terms.
1. Scope of Services
Gordon Technical provides professional technical services including, but not limited to:
- Equipment calibration
- Preventive maintenance
- Equipment inspection
- Equipment repair
- Troubleshooting
- Technical consulting
- On-site laboratory services
- Related support services
Services are performed in accordance with the applicable scope of work, quotation, service agreement, or purchase order.
2. Scheduling
Requested service dates are estimates only.
Although we make every effort to meet scheduled appointments, circumstances beyond our control may require rescheduling.
Scheduling priorities may change due to emergencies, weather, travel conditions, equipment availability, or customer requests.
3. Customer Responsibilities
Customers are responsible for providing:
- Safe access to the work area
- Adequate electrical power when required
- Necessary operator assistance when applicable
- Reasonable access to equipment
- A safe working environment
Customers are responsible for ensuring equipment is available and ready upon technician arrival.
Delays caused by unavailable equipment or inaccessible work areas may reduce the amount of work completed during the scheduled visit.
4. Technician Safety
Safety is our highest priority.
Our technicians may refuse to perform work that they reasonably believe presents an unsafe condition, including but not limited to:
- Electrical hazards
- Unsafe equipment
- Hazardous environments
- Unsafe lifting conditions
- Lack of required safety equipment
- Any condition that places personnel at unreasonable risk
Such decisions shall not constitute a breach of contract.
5. Equipment Condition
Customers are encouraged to present equipment in a condition suitable for servicing.
Gordon Technical reserves the right to refuse service on equipment that is unsafe, contaminated, damaged beyond reasonable servicing, or otherwise unsuitable for inspection or calibration.
6. Calibration Results
Calibration results are determined solely by the measured performance of the equipment at the time of service.
Gordon Technical cannot guarantee that any equipment will pass calibration before testing is performed.
If equipment does not meet applicable acceptance criteria, a failed calibration report may be issued.
7. Repairs and Adjustments
If repairs or adjustments are recommended during service, Gordon Technical will discuss available options with the customer before additional billable work is performed whenever reasonably possible.
No repair work beyond the agreed scope will be performed without customer authorization, except where necessary to protect personnel or equipment.
8. Failed Equipment
If a customer elects not to authorize repairs or adjustments after a failed calibration, Gordon Technical may issue documentation reflecting the equipment’s measured condition.
The customer remains responsible for determining whether the equipment should remain in service.
9. Service Interruptions
If work cannot reasonably continue because:
- equipment is unavailable,
- required personnel are absent,
- utilities are unavailable,
- safety concerns exist, or
- other customer-controlled conditions prevent work,
our technician may continue with other scheduled work or leave the site.
Additional visits required to complete the remaining work may result in additional charges.
10. Travel Charges
Travel charges may apply depending on the location of the customer and the scope of work.
Applicable travel charges will normally be identified during quotation or scheduling.
11. Service Reports
Following completion of service, Gordon Technical may provide documentation including:
- Calibration certificates
- Inspection reports
- Service reports
- Repair documentation
- Recommendations
- Other technical records
These documents represent the condition of the equipment at the time the service was performed.
12. Calibration Report Integrity
Calibration certificates, reports, and other technical documents issued by Gordon Technical may not be altered, edited, partially reproduced, or misrepresented without our prior written permission.
Unauthorized modification of calibration documentation may invalidate its intended use.
13. Record Retention
Calibration and service records are generally retained for a minimum of five (5) years unless a longer retention period is required by law, accreditation requirements, or contractual agreement.
14. Accreditation
Where applicable, calibration services are performed under Gordon Technical’s accredited quality management system.
Only services specifically identified as accredited are represented as such.
Nothing in these Terms expands or modifies the scope of Gordon Technical’s accreditation.
15. Customer Equipment
Customers retain ownership of all equipment submitted for service.
Gordon Technical exercises reasonable care while equipment is in our possession but is not responsible for pre-existing damage, normal wear, hidden defects, or failures unrelated to the services performed.
16. Limitation of Liability
To the fullest extent permitted by law, Gordon Technical’s total liability arising from any service shall not exceed the amount paid for the specific service giving rise to the claim.
Gordon Technical shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
- Lost profits
- Lost production
- Business interruption
- Delay damages
- Lost contracts
- Lost data
- Equipment downtime
- Replacement labor
- Third-party claims
17. Force Majeure
Gordon Technical shall not be responsible for delays or inability to perform services caused by events beyond our reasonable control, including:
- Weather
- Natural disasters
- Utility failures
- Transportation disruptions
- Supply shortages
- Government actions
- Labor shortages
- Pandemics
- Cybersecurity incidents
- Acts of God
18. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Virginia.
19. Venue
Any dispute arising under these Terms shall be brought exclusively in the state or federal courts having jurisdiction over Chesterfield County, Virginia.
20. Changes to These Terms
Gordon Technical may revise these Terms from time to time.
Updated Terms apply only to services scheduled after the revised Effective Date.
21. Right to Refuse Service
Gordon Technical reserves the right to refuse or discontinue service whenever:
- required safety conditions are not met,
- equipment cannot reasonably be serviced,
- legal or regulatory concerns exist,
- customer conduct is abusive or threatening,
- payment obligations have not been satisfied, or
- other circumstances make performance impractical or unsafe.
